To use PixelShare, you must:

• Not have been previously banned from the Service

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Account Creation

To access certain features of the Service, you must create an account. You agree to:

• Maintain and update your information as needed
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access to your account

Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.

PixelShare provides a platform for uploading, organizing, and sharing photos and videos. Our Service includes:

• Gallery Creation: Create and organize galleries for your photos and videos
• Sharing: Share galleries with others via unique links, with optional password protection
• Storage: Store full-resolution photos and videos on our cloud infrastructure
• Collaboration: Invite others to contribute to your galleries (on applicable plans)

Service Availability

While we strive to maintain high availability, we do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

Ownership

You retain all ownership rights to the content you upload to PixelShare ("User Content"). We do not claim ownership of your photos, videos, or other materials.

License to PixelShare

By uploading User Content, you grant PixelShare a limited, non-exclusive, royalty-free, worldwide license to:

• Store, process, and display your content as necessary to provide the Service
• Create thumbnails and optimized versions for viewing
• Share your content with those you choose to share it with

This license exists solely to operate the Service and terminates when you delete your content or account.

Your Responsibilities

You are solely responsible for your User Content. You represent and warrant that:

• You own or have the necessary rights to upload and share your content
• Your content does not infringe any third-party rights
• Your content complies with these Terms and all applicable laws

You agree not to use the Service to:

• Upload, share, or distribute illegal content
• Share content that exploits, harms, or endangers minors
• Distribute malware, viruses, or harmful code
• Engage in harassment, bullying, or threatening behavior
• Impersonate others or misrepresent your affiliation
• Violate intellectual property rights of others
• Attempt to gain unauthorized access to our systems
• Use automated tools to scrape or collect data without permission
• Interfere with or disrupt the Service or its infrastructure
• Use the Service for spam or unsolicited communications

Content Moderation

• Reverse engineer or attempt to extract our source code
• Use our trademarks, logos, or branding without permission
• Create derivative works based on the Service

DMCA & Copyright Claims

We respect intellectual property rights. If you believe content on PixelShare infringes your copyright, please contact us at support@pixelshare.app with the following information:

• Description of the copyrighted work
• Location (URL) of the infringing content
• Your contact information
• A statement of good faith belief that the use is unauthorized
• A statement under penalty of perjury that the information is accurate
• Your physical or electronic signature

Free & Paid Plans

PixelShare offers both free and paid subscription plans. Free plans include limited storage, while paid plans provide additional storage, features, and capabilities.

Billing

• Paid subscriptions are billed monthly or annually, as selected
• Payment is due at the beginning of each billing period
• All fees are non-refundable unless otherwise stated
• We may change pricing with 30 days advance notice

Cancellation

You may cancel your subscription at any time from your account dashboard. Upon cancellation:

• You will retain access until the end of your current billing period
• Your account will revert to the free plan
• Content exceeding free plan limits may become inaccessible until storage is reduced or a paid plan is restored

Refunds

We offer a 30-day money-back guarantee for first-time subscribers to paid plans. To request a refund, contact us at support@pixelshare.app within 30 days of your initial purchase.

Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature (when available). Upon termination, your right to use the Service immediately ceases.

Termination by Us

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms or our Acceptable Use Policy
• Your use of the Service poses a security risk
• Required by law or legal process
• We discontinue the Service (with reasonable notice)

Effect of Termination

Upon termination, your content will be deleted in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and indemnification.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of any content
• Warranties that defects will be corrected

You use the Service at your own risk. We are not responsible for any content uploaded by users or any third-party conduct.

This includes, but is not limited to:

• Loss of profits, revenue, data, or goodwill
• Cost of substitute services
• Damages arising from unauthorized access to your content
• Damages arising from interruption or loss of service

In no event shall our total liability exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

You agree to indemnify, defend, and hold harmless PixelShare and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable law

Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Dispute Resolution

Before initiating any legal action, you agree to first contact us at support@pixelshare.app to attempt to resolve the dispute informally. We will work in good faith to resolve any issues within 30 days.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PixelShare regarding the Service.

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Notify you via email or through the Service for significant changes
• Provide at least 30 days notice before changes take effect (for material changes)

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
